1. Acceptance of Terms

These Terms of Service (“Terms”) are a legal agreement between you (“you”, “your”) and Ruck Social Ltd (“Ruck”, “we”, “us”, “our”), governing your access to and use of the Ruck mobile application (the “App”), our website at https://www.ruck.social (the “Website”), and any related services we provide (collectively, the “Services”).

By downloading, installing, creating an account, or using our Services in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.

You may only use the Services if:

  • You are at least 18 years old;

  • You are a natural person (not a company or organization);

  • You have not been convicted of, or pleaded guilty/no contest to, a felony, a sexual offense, or any offense involving violence;

  • You are not required to register as a sex offender;

  • Your use of the Services is not prohibited by law in your location.

We reserve the right to refuse access to anyone who fails to meet these eligibility requirements.

2. Changes to These Terms

We may update these Terms from time to time. Changes will take effect when posted within the App or on the Website, with a notice provided at least 30 days in advance where required by law. Continued use after changes take effect means you accept the updated Terms.

3. Accounts & Security

To use certain features of the Services, you must create an account using an approved sign-in method (e.g. Sign in with Apple, Sign in with Google, or other options we may provide). You agree to provide accurate, current, and complete information during registration, and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms.

4. Intellectual Property

The Services and all related content, features, and functionality are owned by Ruck or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, distribute, modify, create derivative works of, publicly display, or exploit any content from the Services without our prior written consent.

5. Prohibited Conduct

You must not use the Services to:

  • Break any laws or regulations;

  • Exploit or harm minors;

  • Send spam or unsolicited messages;

  • Harass, threaten, or defame others;

  • Post content that is obscene, pornographic, hateful, violent, or otherwise objectionable;

  • Impersonate others or misrepresent your identity;

  • Introduce malware or disrupt the Services;

  • Create accounts for others or use another user’s account without permission.

We reserve the right to remove any content or suspend users who violate these rules.

6. User Content

You may submit text, images, or other materials (“User Content”) via the Services. You retain full ownership of your User Content.

For publicly visible content (such as your profile, public photos, or posts viewable by other users without explicit sharing), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as necessary to operate and provide the Services.

For private content (including private albums and direct messages):

  • Ruck does not access, view, or use this content for any purpose other than securely storing and transmitting it to the intended recipients.

  • Such content is end-to-end encrypted where technically possible, and is only visible to you and the users you choose to share it with.

  • We will only access private content if legally required (for example, in response to a valid court order or law enforcement request) or if necessary to investigate a report of a serious violation of these Terms or applicable law, and only to the extent required.

You are solely responsible for your User Content and must ensure it complies with these Terms and our Community Guidelines. We are not responsible for User Content posted or shared by other users.

7. Subscriptions & Purchases

Some features require payment via in-app purchase (“Subscription”). Prices, durations, and benefits are shown within the App.

  • Billing: Subscriptions are billed through your Apple App Store or Google Play account and renew automatically unless cancelled at least 24 hours before the end of the current period.

  • Cancellation: You can cancel anytime in your App Store or Google Play account settings.

  • Refunds: Refunds are handled solely by Apple or Google according to their policies. We cannot process refunds directly.

  • Price Changes: If we change Subscription prices, you will be notified in advance and given the option to cancel before the change applies.

8. Age Verification (UK & Certain Jurisdictions)

Where required by law, you must complete age verification before accessing certain features (such as messaging, private albums, and sending or receiving likes). We may use third-party providers to perform these checks. By using these features, you consent to this process.

9. Disclaimers & Limitation of Liability

We provide the Services “as is” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.

We are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

10. Indemnification

You agree to indemnify and hold harmless Ruck and its affiliates from any claims, damages, or expenses arising from your use of the Services or your breach of these Terms.

11. Governing Law & Disputes

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter are governed by:

  • If you reside in the United Kingdom – the laws of England and Wales.

  • If you reside in the United States – the laws of the State of New York, USA.

  • If you reside in Canada, the European Union, Australia, or any other country – the laws of England and Wales, without prejudice to any mandatory consumer protections provided by the laws of your country of residence.

Where permitted by your local laws, any dispute shall be resolved by binding arbitration on an individual basis, and you waive any right to participate in a class action or representative proceeding. If binding arbitration is not permitted in your jurisdiction, disputes shall be submitted to the competent courts of your country of residence.

12. Dispute Resolution

12.1 Informal Resolution

Before taking any formal action, you agree to contact us at contact@ruck.social so we can try to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

12.2 Binding Arbitration (UK & US Only)

If you reside in the United Kingdom or United States, and your local law allows it, any dispute, controversy, or claim arising out of or relating to these Terms or the Services will be referred to and finally resolved by binding arbitration:

  • UK residents: Administered by the London Court of International Arbitration (LCIA) under the LCIA Rules, with English as the language of the proceedings.

  • US residents: Administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with English as the language of the proceedings.

Arbitration will be conducted by a single arbitrator, and the award will be final and binding on the parties.

12.3 No Class Actions (Where Permitted)

Where allowed by law, disputes must be resolved on an individual basis, and neither you nor Ruck may bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

12.4 Other Jurisdictions (EU, Canada, Australia, etc.)

If you reside in a jurisdiction that does not permit binding arbitration or class action waivers in consumer contracts:

  • Disputes will be resolved exclusively by the competent courts of your country of residence; and

  • You will also retain any rights you are entitled to under the consumer protection laws of your country of residence.
